Terms & Conditions

 

Welcome to Kidz Party Wheelz!

These Terms and Conditions govern all bookings, equipment hires, and services provided by Kidz Party Wheelz (ABN: 69 202 593 533). By making a deposit or completing a booking on our website, you agree to be bound by the terms outlined below.

1. Quotes, Deposits and Bookings
Quote Validity

All quoted prices and equipment availability are valid for 7 days from the date the quote is issued, unless otherwise stated.

Deposit Requirements
To secure your event date, the following non-refundable deposit is required:

  • Standard parties and packages: $300 non-refundable deposit

  • Large events: $600 non-refundable deposit

Once the deposit has been recieved you will be sent an invoice detailing the due date and balance outstanding.

Why the Deposit is Non-Refundable
The deposit is non-refundable because, like all event businesses, we incur administration, staffing, scheduling, preparation, and booking opportunity costs when reserving your date. Once your event is booked, that date and time may no longer be available to other clients.

Booking Confirmation
Your booking is only confirmed once the required deposit, or full payment, has been received.

2. Payment Terms and Balance Due
Final Balance Due
The remaining balance for your booking must be paid in full at least 10 days prior to the scheduled event date, as detailed on your invoice.

Late Payments
If full payment is not received at least 10 days prior to the event, Kidz Party Wheelz reserves the right to cancel the booking and release the time slot to other clients if no communciation has been recieved. In that case, all deposits paid will be forfeited.

Accepted Payment Methods
Payments may be made online via credit card, or via direct bank transfer / invoice upon request.

3. Cancellations, Rescheduling and Refunds

Client Cancellations

All deposits are strictly non-refundable.

If a client cancels their booking:

  • 10 days or less before the event: no monies paid will be refunded

  • 11 days or more before the event: monies paid will be refunded less the non-refundable deposit

Rescheduling

Requests to reschedule an event must be made in writing and are subject to equipment, staffing, and date availability.

  • Rescheduling requests made 7 days or more before the event: may be accommodated subject to availability

  • Rescheduling requests made less than 7 days before the event: incur a $150 rescheduling fee, subject to availability

Approval of a reschedule is at the sole discretion of Kidz Party Wheelz and is not guaranteed.

Inclement Weather

Safety is our priority. If an outdoor event cannot proceed due to severe, unsafe, or wet weather conditions, Kidz Party Wheelz may, at its discretion, offer either:

  • a full refund, or

  • a complimentary reschedule to an agreed available date

This applies only where the event cannot safely proceed due to weather conditions as determined by Kidz Party Wheelz.

4. Event Times, Delivery, Access and Setup

Agreed Start Time

Your booking start time begins at the agreed booked start time, not the guest arrival time or any later time requested on the day.

If Kidz Party Wheelz is delayed due to circumstances beyond our reasonable control, including but not limited to road closures, traffic incidents, accidents, weather conditions, or access delays, the event start time will commence upon our actual arrival, and Kidz Party Wheelz will not be liable for any resulting reduction in operating time or related loss.

Delivery Fees

Delivery fees are charged in accordance with the Kidz Party Wheelz delivery schedule, as applicable to the venue location and service area, and will be detailed on your booking invoice or quote.

Venue Access

The client must ensure Kidz Party Wheelz has safe, clear, and unrestricted access at least 1 hour prior to the event start time for delivery, unloading, setup, and preparation.

This includes:

  • free and unobstructed access to the driveway, loading dock, or other suitable unloading area

  • safe and practical access for staff to move equipment to and from the setup area

  • parking and access that is not blocked, restricted, or subject to delay

If access is not available as required, Kidz Party Wheelz is not responsible for delays, shortened hire time, or inability to fully deliver the booked service.

5. Safety, Supervision and Venue Requirements

Adult Supervision Required

Children using Kidz Party Wheelz vehicles or equipment must be under active adult or parental supervision at all times.

Parents, guardians, and supervising adults remain solely responsible for the conduct, safety, and behaviour of children attending or participating in the event.

Surface and Operating Area

Vehicles and circuits must only be operated on dry, flat, smooth, and clear surfaces, including suitable grass, concrete, asphalt, or indoor hall flooring.

Operation is strictly prohibited on or near:

  • steep inclines

  • gravel

  • deep mud

  • uneven or unsafe surfaces

  • open water or other hazardous areas

Capacity and Age / Weight Limits

Equipment must only be used within the age, size, and weight guidelines specified by Kidz Party Wheelz. Unless otherwise advised, this is generally up to 30kg per child.

Kidz Party Wheelz reserves the right to stop usage at any time if equipment is being used unsafely or outside of permitted guidelines.

6. Hosts and On-Site Assistance

Where Kidz Party Wheelz provides a host or event staff member, that person is present to assist with the operation and flow of the activity only.

Hosts may assist with:

  • guiding vehicles

  • assisting with turn-taking and timing of children on the cars

  • basic operational support for the activity

However:

  • hosts are not babysitters

  • hosts are not responsible for child supervision

  • hosts are not responsible for the safety, behaviour, or control of children

  • ultimate responsibility for child safety and supervision remains with the child’s parent, guardian, or supervising adult at all times

While our hosts will always endeavour to promote safe and orderly use of the equipment, this does not transfer legal responsibility for supervision or safety away from the parent, guardian, venue, or event organiser.  All hosts do have valid and current working with child check certification.

7. Equipment Care, Damage, Theft and Cleaning

Ownership

All vehicles, tracks, batteries, barriers, signage, and other event equipment remain the exclusive property of Kidz Party Wheelz at all times.

Damage and Theft Responsibility

The client assumes full financial responsibility for any theft, loss, vandalism, misuse, or deliberate or negligent damage to Kidz Party Wheelz equipment caused by the client, event guests, attendees, children, contractors, or any person present at the venue during the hire period.

Repair and Replacement Costs

The client agrees to pay the full cost of professional repair or complete replacement of any damaged, lost, or stolen equipment. Kidz Party Wheelz may issue an invoice for such costs immediately following the event, and payment must be made by the due date stated on the invoice.

Non-Payment of Damage Costs

If the client fails to pay for repair, replacement, cleaning, loss, or damage costs when due, Kidz Party Wheelz reserves the right to pursue recovery of the debt by any lawful means available, including debt collection action, legal proceedings, and recovery of associated enforcement or recovery costs where permitted by law.

Excessive Cleaning Fee

Vehicles or equipment returned in an excessively soiled condition, including due to food, soft drink, thick mud, paint, or heavy debris, will incur a $40 cleaning fee per unit, billed separately.

8. Client Insurance and Risk

Kidz Party Wheelz maintains its own applicable business and public liability insurance as required for its operations.

However, clients are responsible for determining whether they require any additional insurance for their event, venue, guests, or activities. If you require coverage beyond that held by Kidz Party Wheelz, including event insurance or venue-specific insurance, you must arrange this yourself at your own cost.

Kidz Party Wheelz does not provide advice as to the adequacy of a client’s personal, event, or venue insurance arrangements.

9. Limitation of Liability and Indemnity

Assumption of Risk

The client acknowledges that the use of ride-on vehicles, tracks, and related event equipment involves inherent risks, including the risk of injury, accident, collision, or property damage.

By proceeding with the booking, the client accepts these risks on behalf of themselves and all attendees using or accessing the equipment, to the maximum extent permitted by law.

Exclusion of Liability

To the fullest extent permitted by law, Kidz Party Wheelz, its owners, staff, contractors, and hosts accept no responsibility and shall not be liable for any injury, death, loss, damage, cost, expense, delay, claim, or liability of any kind arising from or related to:

  • use or misuse of the equipment

  • unsupervised play

  • failure to follow instructions or safety directions

  • negligent, reckless, or inappropriate conduct by guests or attendees

  • unsuitable venue conditions

  • acts or omissions of the client, parents, guardians, venue staff, or third parties

  • delays caused by circumstances beyond our reasonable control

This includes, without limitation, personal injury, property damage, consequential loss, indirect loss, loss of enjoyment, and economic loss.

No Responsibility for Supervision

Kidz Party Wheelz does not accept responsibility for supervising children at any time. The client, parents, guardians, and supervising adults retain full responsibility for ensuring children are appropriately supervised and behave safely.

Indemnity

The client agrees to indemnify and hold harmless Kidz Party Wheelz, its owners, staff, contractors, and representatives from and against any claims, demands, actions, liabilities, losses, damages, costs, or expenses arising from:

  • the client’s breach of these Terms and Conditions

  • unsafe, improper, or unauthorised use of the equipment

  • inadequate supervision of children

  • damage or injury caused by guests, attendees, or third parties connected with the event

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under applicable law, including the Australian Consumer Law.

10. Marketing and Promotional Communications

Direct Marketing

By making a booking or submitting an enquiry, you consent to receive periodic promotional emails, seasonal offers, newsletters, and exclusive discounts from Kidz Party Wheelz and its authorised business brands or partners.

Opt-Out

You may opt out or unsubscribe from marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting us directly.

Transactional Communications

Opting out of promotional communications will not affect essential transactional communications relating to your active booking, including invoices, booking confirmations, reminders, and event updates.
